DELIVERY AND TERMS OF USE

Welcome to the Helsinki Boats website (hereinafter referred to as ”the Website”). MM Experience Oy is responsible for the maintenance of the Website and the provision of its services. Use of the Website and ordering of services require acceptance of these terms and conditions. Please read the terms and conditions carefully before placing an order.

2. Scope

These terms and conditions apply to all services and products offered by MM Experience Oy, ordered through the Website, via email or by telephone, including:

 

Boat and yacht charters with crew
– sauna raft rentals
– catering services
– experience packages
– any related products

 

The mandatory provisions of the Consumer Protection Act (38/1978) shall apply to consumer sales to the extent that these terms and conditions conflict with them.

 

3. Ordering and the formation of the contract

Bookings can be made via the website’s booking system, by email or by telephone. The person making the booking must provide accurate and up-to-date contact details.

 

A contract is formed when:
– the customer has accepted these terms and conditions and made a booking,
– the payment or advance payment has been made (Stripe) or confirmed (invoice), and
– We have sent you an order confirmation by email.

 

We reserve the right not to accept a booking due to, for example, weather conditions, staff shortages, the need for vehicle maintenance or any other valid reason. In such cases, any payment already made will be refunded in full.

 

4. Prices

The prices shown on the website are quoted in euros and include the applicable VAT at the time. Any charges for fuel, port fees, catering and additional services are itemised on the booking form and/or in the booking confirmation.

 

We reserve the right to change prices. The price stated in the order confirmation is binding on the customer.

 

5. Payment

We accept the following payment methods:

 

– Card payment – Visa, Mastercard, American Express. Payment processing by **Stripe Payments Europe Ltd.** (Ireland). Card details are not stored in our systems; Stripe processes them in accordance with PCI-DSS requirements.
– **Invoice or bank transfer** – for business customers and by separate agreement. Payment terms: 14 days net, unless otherwise agreed. Interest on late payments in accordance with the Interest Act.

 

For larger bookings, we may require an advance payment, which must be made by the date specified in the booking confirmation. If the advance payment is not made by the deadline, the booking may be cancelled.

 

6. Delivery and performance of the service

Unless otherwise agreed, the departure point for hire services is **Kanavaranta 4, 00160 Helsinki**. The route, duration and other details of the service will be agreed at the time of booking.

 

The delivery location and time for catering services will be agreed upon when the order is placed.

 

7. Right of withdrawal

7.1 Limitations on the consumer’s right of withdrawal (leisure and recreational services)

 

In accordance with Section 16(1)(12) of Chapter 6 of the Consumer Protection Act, consumers do NOT have a 14-day right of withdrawal** in respect of the following services:

 

”leisure services, if the contract specifies a particular date or period for the provision of the service”.

 

This means that boat and sauna raft hire, as well as other pre-booked experience services, **are not covered by the 14-day right of withdrawal under the Consumer Protection Act**, as the service is provided on a pre-agreed date.

 

7.2 Helsinki Boats’ own cancellation policy (boat and hire services)

We offer our own cancellation policy to our customers. Cancellations must be notified in writing by email to marco@helsinkiboats.com:

| 7–14 days before departure | 25 % |
7 days before departure: No refund

 

If we are unable to perform the service due to weather conditions, equipment failure, or other force majeure, the customer will receive a full refund or may reschedule their booking for another time free of charge.

 

7.3 Catering and other products

Regarding catering orders, cancellation terms are stated in the order confirmation. In general:
– more than 14 days before: full refund
– 7–14 days before: 50 %
– all 7 days before: no refund, as raw materials have been ordered.

 

For physical products (e.g. product boxes), the 14-day right of return according to consumer protection law applies. The product must be unused and in its original packaging. Return costs are the responsibility of the customer, unless otherwise agreed.

 

8. Weather and Safety

The captain / responsible crew member will assess weather and sea conditions before departure. If the conditions are dangerous or prevent the safe operation of the service, the booking will be rescheduled or the customer will receive a full refund.

 

The customer agrees to follow the crew's instructions on board. For safety reasons, the crew has the right to interrupt or terminate the service if the customer or someone in their group behaves in a threatening, disruptive manner, or endangers the safety of others. In such a case, no refund will be given.

 

The customer is obliged to inform the crew of any health restrictions concerning themselves or their group (e.g., pregnancy, heart conditions, allergies) that may affect the performance of the service.

 

9. Exclusion of liability

MM Experience Oy's liability for any service errors is limited to the price paid for the service, unless mandatory legislation dictates otherwise. We are not liable for indirect damages such as loss of earnings, travel arrangements, onward connections, or delays to other services.

 

This limitation does not apply to damage caused by gross negligence or wilful misconduct.

 

10. Vandalism and Damage

The client is liable for damages caused to the vessel or its equipment (excluding normal wear and tear) according to the actual repair or replacement costs. For personal injuries, the applicable insurance and legislation shall be followed.

 

11. Processing of personal data

We process the subscriber’s personal data in accordance with [our privacy policy](https://helsinkiboats.com/tietosuoja/). Placing an order requires that the subscriber has read the privacy policy.

 

12. Cookies

Our website uses cookies, which we will explain in a separate in our cookie policy .

 

13. Intellectual property rights

All content on the Website (text, images, videos, logos, software) is the property of MM Experience Oy or its licensors and is protected by copyright and trade mark law. The content may not be copied, distributed or used for commercial purposes without written permission.

 

14. Links to third-party websites

Our website may contain links to third-party websites. We are not responsible for the content, security, or privacy policies of these sites.

 

15. Force majeure

We are not responsible for delays or failures in performing services if they are due to a force majeure event, such as natural disasters, war, strikes, government orders, pandemics, or other events beyond our control. In such cases, the customer is entitled to either postpone their booking or receive a refund.

 

16. Changes to terms

We reserve the right to update these terms and conditions. The current terms and conditions are always available on the Website. Bookings made are subject to the terms and conditions in force at the time of the order.

 

17. Governing Law and Dispute Resolution

These terms and conditions are governed by Finnish law.
